A South Dakota Standard residential lease agreement outlines the terms of how a landlord will rent a property to a tenant in return for monthly payments. The terms are to be negotiated after the tenant has viewed and shown an interest in the property. After a verbal agreement is made, the landlord will verify the tenant’s credentials (i.e. credit report, employment, income, etc.) through a rental application . Once approved, a lease is signed and the tenant will be responsible for the payment of the security deposit, first (1st) month’s rent, and any other fees or deposits.

Disclosures

Lead-Based Paint Disclosure – Required to be completed by the landlord if the residential unit was built prior to 1978. Must be signed by both landlord and tenant.

Methamphetamines Disclosure  ( § 43-32-30 ) – The landlord must inform the tenant if the property was ever used for the manufacturing of methamphetamines.
