An Illinois real estate power of attorney is a document that gives a Principal a written document so that they will have the ability to choose an Attorney In Fact to help with the management, sale, or refinancing of their real property. This document is usually used for the purpose of providing permission for an attorney to work with buyers in the closing of a sale although it will serve other purposes with regard to real estate only. The Principal must carefully read and accept all of the information contained in the document prior to signing. Once the Principal has completed and collected all of the respective signatures, a Notary Public will be required to complete and acknowledge the form for use by the Attorney In Fact.


Statutes Illinois Power of Attorney Act (§§ 45/1-1 — 45/4-12)

Signing Requirements ( 765 ILCS 5/20 ; 755 ILCS 45/3-3 ) – One (1) Witness  and  Notary Public.

How to Write

Step 1 – Principal and Attorney In Fact’s Information – Provide the following:

  • Principal’s Name
  • City of Residence
  • Principal’s state of residence
  • AND
  • Name the selected Attorney In Fact
  • Attorney In Fact’s City of residence

Step 2 – Location of Property –

  • Provide the physical address of the property to be managed by the Attorney In Fact
  • Enter a legal description of the stated address in the open area in this section

Step 3 – Signatures –

  • The Principal must enter their signature
  • Physical mailing address
  • Telephone Number where the Principal may be reached
  • Principal’s email address
  • AND

The Attorney In Fact, must review the entire witness paragraph and its sections (A through C). If the Attorney In Fact agrees with the information, they must then:

  • Date the Witness’ Signature in mm/dd/yyyy format
  • Enter the Witness’ Signature

Step 4 –  In addition to the Witness, the document will not be effective unless it’s witnessed by a state Notary Public – The Notary, after witnessing the completion and signing of the form, must complete the form by providing:

  • Enter the Principal’s name
  • Enter the name(s) of witness(es)
  • Date the witnessing of the signatures in mm/dd/yyyy format
  • Provide the notary’s signature
  • Date of expiration of the notary’s license
  • Affix the Notary seal
