A New York month-to-month rental agreement is a rental contract with no end date and can be terminated by either the landlord or tenant within one (1) month’s notice. The lease will continue and be renewed automatically with each month and the tenant’s rent payment. During a month-to-month lease, the landlord can increase the rent in accordance with the Rent Protection Guidelines . It is recommended for the landlord to verify any incoming tenant’s information by requiring a rental application to be completed and signed.

  • Outside New York City : § 232-b (one month)
  • Within New York City: § 226-c (thirty days if the tenant has been at the property less than a year; sixty days if the tenant has been at the property between more than one year but less than two years; ninety days if the tenant has been at the property more than two years)
